Commercial General Liability Exclusions j. (5) and j. (6) Are Not the Same

Craig F. Stanovich, Co-Founder and Principal, Austin & Stanovich Risk Managers, LLC

October 19, 2021

Denial of Commercial General Liability (CGL) coverage for certain types of property damage claims made against contractors or other repair or service business frequently cite exclusions j. (5) and j. (6), or as Randy Maniloff has named these exclusions, the “double js.” Put another way, these exclusions are appropriately labeled “double js” because if an insurer is citing one “j.”, it will almost always cite the other “j.” as a basis for a coverage denial. Rodney Johnson, Divisional Vice President, Culture and Inclusion, Gallagher; Larry Phillips, Assistant Vice President, Culture and Inclusion, Gallagher; Natalie Douglass, Chief Legal Director, Management Liability Practice, Gallagher

October 25, 2021

Diversity, equity and inclusion (DEI) initiatives have been gaining momentum over the past decade, with much of the growth fueled by recent movements such as #metoo and Black Lives Matter. Companies are increasingly compelled to examine their own diversity and inclusion—based not only upon these movements, but also upon study after study that reinforce DEI's organizational value. In Diversity Wins: How Inclusion Matters, researchers found that companies with significant gender diversity are likely to outperform their less diverse peers; specifically, the study suggests a 48% difference between the most and least gender–diverse companies. Similarly, researchers found that companies in the top quartile in terms of cultural/ethnic diversity outperformed those in the bottom quartile by 36%. These facts are making their way to boardrooms, where DEI is becoming an even more pressing topic. In a recent study, 84% of board of directors' survey respondents agreed that companies should do more in terms of DEI. Read more…
